The Process of Obtaining a Protective Order in Texas

The beginning of the process is to claim that an act of family violence has been committed against you or you fear I could be committed. You and your lawyer can file the petition with the court. The court will examine the petition and have a hearing usually within two weeks of when the petition is filed. If successful, you can have a protective order against your abuser for up to two years.

A protective order can do many things to help make you safer, including:

  • Preventing them from taking your children
  • Preventing communication or threats
  • Not allowing them near your home or work
  • Required classes related to family violence or anger management
  • Not allowing them near your children’s school or daycare
